Purpose and Scope
This policy has been prepared for the employees of BİSOFT BİLGİ TEKNOLOJİLERİ ANONİM ŞİRKETİ based on Article 14 of the Turkish Labor Law No. 4857, which states: “a written employment relationship established on the basis of employees performing their work either at home or outside the workplace through technological communication tools, within the work organization created by the employer.”
This policy covers all employees of BİSOFT BİLGİ TEKNOLOJİLERİ ANONİM ŞİRKETİ.
Fundamental Principles
Arrangements regarding the place where remote work will be performed shall be completed before the commencement of work. The method of covering the costs arising from these arrangements is determined jointly by the remote employee and the employer.
Unless otherwise agreed in the employment contract, it is essential that the materials and work tools necessary for the production of goods and services by the remote employee are provided by the employer. The principles of use, maintenance, and repair of these materials and work tools shall be clearly communicated to the remote employee. The list of work tools provided by the employer shall be delivered in writing to the employee, and a signed copy by the employee shall be kept in the employee’s personnel file by the employer.
In our company, the method and time frame of communication during remote work shall be determined jointly by the remote employee and the employer.
Our company shall inform the remote employee about business rules and relevant legislation regarding the protection and sharing of workplace and job-related data, and shall take the necessary measures for data protection. The definition and scope of data to be protected shall be determined in the contract by the employer. The remote employee is obliged to comply with the business rules set by the employer for the protection of such data.
In our company, the time frame and duration of remote work shall be specified in the employment contract. Subject to legal limitations, the parties may agree to changes in working hours. Overtime may be carried out in accordance with legal provisions upon the employer’s written request and with the employee’s consent.
Considering the nature of the work performed remotely, our company shall inform the employee regarding occupational health and safety measures, provide necessary training, ensure health surveillance, and take required occupational safety measures related to the equipment provided.
